12. Risk of Loss

Risk of loss and responsibility for the Product transfers to the customer upon delivery to the shipping address provided during checkout, or as otherwise provided under applicable law.

Customers are responsible for promptly inspecting all deliveries upon receipt and notifying us within a reasonable period if the package appears damaged, incomplete, or incorrect.

13. Returns & Refunds

Returns, exchanges, cancellations, and refunds are governed by our Return & Refund Policy, which forms part of these Terms.

By placing an order, you acknowledge that you have read and accepted our Return & Refund Policy.

Nothing in these Terms limits any mandatory consumer rights that cannot be excluded under applicable law.

14. Product Use & Suitability

Customers are responsible for ensuring that the Product is suitable for their intended use and that the child using the Product meets the applicable age, height, and weight recommendations stated for the Product.

Junior Rider provides product information and recommendations for general guidance. Children develop differently, and parents or guardians remain responsible for determining whether their child is able to use the Product appropriately.

The Product must only be used in accordance with the official instructions, safety information, and limitations supplied with the Product.

If you are uncertain whether the Product is appropriate for your child or intended activity, please contact our customer support before use.

15. Product Safety & User Responsibilities

The safe use of the Product depends upon proper setup, regular inspection, correct adjustment, and careful use.

By purchasing or using the Product, the customer acknowledges and agrees that:

  • The Product must be assembled and adjusted strictly in accordance with the official instructions supplied with the Product.
  • Before every use, all straps, buckles, attachment points, platform components, and safety components must be inspected to ensure they are properly secured and free from damage, excessive wear, deformation, or loosening.
  • The Product must not be used if any component appears damaged, loose, missing, worn, cracked, or otherwise unsafe.
  • The Product must never be modified, repaired using unauthorized components, or used in any manner inconsistent with the supplied instructions.
  • The child must always be properly secured using the provided child restraint system.
  • The Product must only be used within the published age, height, and weight limits.
  • An adult must supervise the child at all times while the Product is being used.
  • The Product should only be used for activities and environments appropriate for the Product and the child's abilities.
  • Users should avoid running, jumping, climbing, or other activities that may create unnecessary risk while carrying a child.
  • The Product must not be used if the adult or child is unable to maintain proper balance or control.
  • Failure to follow the instructions, safety warnings, inspection requirements, or operating guidelines may significantly increase the risk of injury.
  • Users must immediately stop using the Product if any component becomes loose, damaged, cracked, excessively worn, deformed, or otherwise appears unsafe.

16. Warranty

Junior Rider provides a limited warranty covering manufacturing defects for the period stated in our Warranty Policy.

The warranty does not apply to damage resulting from:

  • Improper assembly or adjustment
  • Misuse
  • Abuse
  • Accidents or falls
  • Normal wear and tear
  • Failure to inspect or maintain the Product
  • Unauthorized modifications or repairs
  • Use outside the intended specifications
  • Commercial or rental use unless expressly authorized
  • Improper storage
  • Environmental exposure
  • Failure to follow maintenance instructions
  • Use of non-approved accessories

The Warranty Policy forms part of these Terms.

17. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Junior Rider shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of profits, business interruption, loss of use, or other economic losses arising from the use of the Services or Products.
  • Our total aggregate liability arising out of or relating to any purchase or use of the Product shall not exceed the purchase price actually paid for the Product giving rise to the claim.
  • Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including mandatory consumer protection or product liability laws.

19. Third-Party Services

Third-party providers operate independently, and their services are governed by their own terms and privacy policies. To the extent permitted by law, Junior Rider is not responsible for their acts, omissions, or policies.

20. Privacy

Your personal information is collected, processed, and stored in accordance with our Privacy Policy, which forms part of these Terms.

By using the Services, you acknowledge that your information may be processed as described in our Privacy Policy.

21. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Hong Kong Special Administrative Region, without regard to conflict of law principles.

Nothing in these Terms limits any mandatory consumer rights available under the laws applicable to your place of residence where such rights cannot lawfully be excluded.

22. Force Majeure

Junior Rider shall not be liable for any delay or failure to perform its obligations resulting from events beyond our reasonable control, including but not limited to natural disasters, pandemics, labor disputes, governmental actions, war, terrorism, cyberattacks, interruptions to transportation networks, utility failures, supplier disruptions, or carrier delays.

23. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect.

24. Stop Use Immediately

The Product must immediately be removed from use if any component becomes loose, detached, missing, damaged, cracked, deformed, or otherwise appears abnormal.

The Product must not be used again until it has been properly inspected and it has been determined that continued use is appropriate.

25. Accidents, Falls & Use of the Product

Use of Junior Rider products involves inherent risks associated with carrying a child, including, but not limited to, falls, loss of balance, instability, trips, collisions, injury, and property damage.

Customers are responsible for using the Product in accordance with the applicable instructions, safety warnings, age and weight limitations, adjustment requirements, and applicable laws and regulations.

The adult user is responsible for ensuring that the Product is properly adjusted, that the child is properly secured, and that the environment and activity are appropriate for use of the Product.

To the fullest extent permitted by applicable law, Junior Rider shall not be liable for accidents, falls, injuries, or property damage to the extent arising from improper assembly or adjustment, misuse, modification, failure to follow safety instructions, use outside the stated specifications, failure to properly secure the child, or circumstances beyond Junior Rider's reasonable control, except to the extent liability cannot legally be excluded or limited under applicable law.

26. Entire Agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, Warranty Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between you and Hyperloop E Limited concerning the Services and supersede all prior communications or understandings relating to the same subject matter.
